Article 24[Compensation of Damages]
In the event that “B” violates the obligation of confidentiality or intentionally causes damage,all damages incurred as such,except man-made calamity and industrial disaster,shall be borne by “B” within the scope of the contract amount despite any regulations in law and in the contract.
Article 25[Termination or Cancellation of the Contract]
1.“A” shall terminate or cancel the contract after stipulating a fixed period in case of each of the following.
(1) In the event that “B” does not start on the execution of the Service after passing the stipulated date for starting the execution of the Service without fair cause,
(2) In the event that the offering of the Service is not completed within the contract period stipulated in the contract,or it is clearly admitted that there is no possibility that the offering of the Service can be completed owing to the fault of “B”,
(3) In the event that it is determined that there is no possibility that the offering of the Service can be completed even if the contract execution period is prolonged
(4) In the event that it is admitted that the objective of the contract cannot be attained owing to violation of other contract conditions,
2.In the event that any of the following arise,“A” or “B” may terminate or cancel the contract without giving notification to the other party.
(1) In the event that a bill or check issued is in default or its transaction is suspended,
(2) In the event that procedures such as bankruptcy,composition,or court receivership are initiated,
(3) In the event that major properties are under seizure or auction by receiving a disposition of delinquency,
3.“A” or “B” may terminate or cancel this contract when each of the following is not rectified within 30 (thirty) days by stipulating and notifying the period to the other party.
(1) In the event that “A” delays payment for the Service or violates the payment conditions,
(2) In the event that “B” delays delivery of the product,
(3) In the event that “A” or “B” becomes laid under temporary seizure or temporary disposition owing to the aggravation of credit,
(4) In the event that “A” or “B” violates this contract,
4.In the event that the contract is terminated or canceled,“B” shall return original copy and transcript of all documents and data offered by “A”; however,both parties shall determine an already gained outcome in such cases.
